Terms and Conditions of Sale
If purchasing alcoholic beverages from Cult Wines International LLC, by checking the agreement box and completing your transaction, you explicitly certify, warrant, and agree to the following binding statements:
1. Age Verification & Delivery Mandate
Legal Drinking Age: Buyer certifies that they are twenty-one (21) years of age or older, and understands that the purchase, receipt, or distribution of alcohol to anyone under 21 is strictly prohibited by law.
Adult Signature Required: Buyer acknowledges that an authorized adult (21+) must be physically present to provide valid photo identification and sign for the package upon delivery.
No P.O. Boxes: Deliveries to USPS P.O. Boxes, APO/FPO addresses, or unstaffed drop-boxes are legally prohibited.
2. Shipping Schedules & Transit Management
Fulfillment Directive: Unless the Buyer chooses “Weather Hold” or explicitly inputs delayed shipping instructions in the Order Notes field at checkout, the Buyer instructs us to ship the inventory at the earliest available window utilizing proper commercial shipping safety guidelines.
Standard Shipping Schedule: To prevent delicate inventory from sitting in un-refrigerated transit hubs over weekends, standard shipping dispatches are limited to:
FedEx Ground: Monday and Tuesday only (for transits exceeding 3 days).
FedEx 2-Day Air: Monday through Wednesday.
FedEx Overnight & Florida Local: Monday through Thursday.
Weather-Related Delays: Cult Wines International LLC reserves the absolute right to enforce a mandatory shipping hold during imminent or ongoing extreme weather events (such as heatwaves, hurricanes, or winter freezes) to safeguard the physical viability of the wine.
3. Allocation of Risk and Damage Exclusions
Thermal Exposure Disclaimer: Because the Buyer maintains total control over when the wine is shipped, Cult Wines International LLC assumes absolutely no liability for transit-related thermal damage, wine spoilage, cork pushing, or weeping. If the weather is unfavorable, the Buyer assumes all climate risks unless they request a complimentary weather hold.
Shipping Insurance Limitations: Third-party shipping insurance covers strictly total carrier loss, theft, or physical bottle breakage (shattered glass). It does not cover transit delays, weather exposure, oxidation, or cosmetic label/capsule damage.
Tamper-Evident Packaging: All shipments are sealed with specialized security tape. If the tape appears cut, torn, or compromised upon arrival, the Buyer must refuse the package immediately, instruct the carrier to mark it as “Refused Due to Tampering,” and notify us within twenty-four (24) hours. Once a package is signed for, the chain of custody is legally complete, and liability terminates.
4. Jurisdiction, Compliance, and Fraud Prevention
Passage of Title & Place of Sale: Absolute ownership, title, and risk of loss pass entirely to the Buyer within the State of Florida at the exact moment payment is processed. The Buyer represents that they are compliant with all local, state, and international liquor laws regarding importation, licenses, and quantities, and authorizes Cult Wines International LLC to act solely as their service agent in arranging logistics.
Fraud & Order Cancellation: Cult Wines International LLC reserves the right to cancel and fully refund any order at our sole discretion. If your billing and shipping addresses do not match, you may be required to submit proof of identity prior to shipment.
International Shipments: International Buyers assume full responsibility for all local customs, broker fees, excise taxes, and import duties. If a package is rejected, abandoned, or delayed by customs due to tax non-payment, no refunds will be issued.
5. Product Integrity, Storage, and Authenticity Guarantee
Vintage Wine Quality Disclaimer: Wine is an organic, living commodity that changes naturally over time. Cult Wines International LLC provides accurate physical assessments but cannot guarantee cork structural integrity, liquid quality, or the peak drinking window of older vintages. Cork crumbling or natural oxidation are inherent risks assumed entirely by the Buyer in the rare wine trade.
Restocking and Abandonment Fees: The Buyer agrees to the strict return parameters and storage schedules outlined in our full policy page, including the 25% restocking fee covering product devaluation due to address errors, and total forfeiture for unretrieved warehouse abandonment.
Premium Authenticity Guarantee: Every single vintage bottle in our inventory undergoes a rigorous, multi-point physical and structural inspection to verify its provenance before being offered for sale. In the highly exceptional event that a bottle is definitively proven to be non-authentic by a mutually agreed independent expert, Cult Wines International LLC will immediately issue a full refund of the original purchase price upon its safe return. Our total liability is strictly limited to this original purchase price; consequential damages or future market appreciation claims are explicitly excluded.
